On this basis, the rule of no crime without a text has not found application in the disciplinary field, and the competent authorities to impose penalties have the right to weigh the actions attributed to the employee and estimate the appropriate penalty for them, and forging documents, papers and official documents issued by the Registration Division is a crime that entails three responsibilities: administrative Criminal and civil, and since the employee is bound by law to obey his superiors, the legislator denied responsibility for him in Article 315 of the Civil Code and Article 40 of the Iraqi Penal Code. Administrative responsibility is also excluded based on the applicable state employee discipline law, but denial of responsibility must be within the conditions specified by the laws above.
