To claim these expenses, the authorized employee shall issue a prior warning to the debtor and creditor, warning them that the student must pay within ten days, starting from the day following the notification, pursuant to the provisions of Article (3) thereof. If the student or guarantor fails to comply with the warning and the period expires, the authorized employee shall first seize the debtor’s movable assets, and then the immovable assets if the former are insufficient, equivalent to the requested amount, pursuant to the provisions of Article (5) of the above law.<\/p>\n
Based on the foregoing, we can state that the amounts incurred as a result of breach of the academic contract are government debts due and payable by both the debtor student and their joint guarantor. These procedures are intended to preserve the rights and assets of the state and prevent evasion thereof.
