On Wednesday, October 15, 2025, a master’s thesis by student Mahmoud Abdullah Hussein Thanoun Al-Naimi, titled “Kinship and Its Impact on Civil Lawsuits – A Comparative Study,” was discussed at the College of Law at the University of Mosul.<\/p>\n

The thesis addressed the impact of kinship on litigation and enforcement procedures, and the potential conflict of interest or impact it may cause on the principle of impartiality. Kinship\u2014whether by blood, marriage, or breastfeeding\u2014is a factor influencing the validity of litigation and the course of lawsuit proceedings. The study demonstrated that the presence of a kinship up to the fourth degree between a judge and one of the parties, or between members of the judicial body and those involved in the lawsuit, constitutes a reason preventing the case from being heard to ensure the impartiality and fairness of the judiciary.<\/p>\n

The thesis aimed to define the nature of kinship and the methods for calculating its degrees, and to demonstrate its impact on the judge’s competence to hear the case and on the procedural representation of the parties before the judiciary, as well as its impact on civil evidence and enforcement.<\/p>\n

After an extensive academic discussion, the committee commended the student’s efforts and the valuable scientific findings contained in his study, which contribute to enriching legal research in the field of civil justice.<\/p>\n
