On August 3, 2014, following the occupation of the city of Mosul on June 10 of the same year, the terrorist ISIS gangs committed the crime of genocide against the Yazidi component in the Sinjar district, targeting their religious, human, and cultural existence.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">These gangs perpetrated the most horrific forms of violence, committing mass killings, persecution on the basis of religious affiliation, the abduction and enslavement of women, the forcible transfer of children, the displacement of thousands of families, as well as the destruction of homes, places of worship, and religious and cultural landmarks, in an attempt to erase the identity of this authentic component and eliminate its existence.<\/span><\/p>\n<hr \/>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">The Legal Classification of the Crime<\/span><\/strong><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">The crimes committed against the Yazidis constitute a clear example of the crime of genocide under international law. The term &#8220;Genocide&#8221; is derived from two roots: &#8220;Genos,&#8221; meaning race or group, and &#8220;Cide,&#8221; meaning killing, thus signifying &#8220;the killing of a human group because of its belonging.&#8221;<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">The United Nations General Assembly recognized genocide as an independent crime in 1946, and the Convention on the Prevention and Punishment of the Crime of Genocide of 1948 established the legal framework for this crime. More than 150 states have acceded to it, and its provisions have become part of the rules of customary international law, binding on all states, whether or not they have ratified it.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">The Rome Statute of the International Criminal Court, adopted in 1998 and entered into force in 2002, stipulates in Article 6 that genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial, or religious group, including:<\/span><\/p>\n<ul>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Killing members of the group.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Causing serious bodily or mental harm to members of the group.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Imposing measures intended to prevent births within the group.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Forcibly transferring children of the group to another group.<\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">By applying these provisions to what the Yazidis suffered in Sinjar, it is clearly evident that all the elements of the crime of genocide were present. The physical element was fulfilled through mass killings, torture, enslavement, forced displacement, destruction of property and places of worship, and the forcible transfer of children. The mental element, consisting of specific criminal intent, was also fulfilled, as these acts targeted the elimination of the Yazidi community as a religious group, in whole or in part, which distinguishes the crime of genocide from other international crimes.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">The targeting was not limited to persons but extended to the religious, cultural, and civilizational identity of the Yazidis, through the destruction of their temples, monuments, and heritage, in an attempt to erase their existence from the region where they had lived for centuries.<\/span><\/p>\n<hr \/>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">On this painful anniversary, we remember the victims with profound sorrow and reverence, and we renew our call to continue efforts aimed at liberating the abducted women and men whose fate remains unknown, working to return them to their families, and ensuring that all those responsible for these crimes are brought to justice, whether they were direct perpetrators, accomplices, or contributors to the planning, execution, or facilitation, in accordance with the provisions of international law and the principles of justice.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">The measures taken by the Iraqi state to provide justice for the victims, foremost among which is the Yazidi Female Survivors Law No. (8) of 2021, represent an important step on the path to justice and redress for the victims. However, they still need to be complemented by practical measures to uncover the fate of all the missing, hold the perpetrators accountable, compensate the affected, and reconstruct the affected areas, thereby achieving transitional justice and preserving the dignity of the victims.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Commemorating this anniversary is not merely a remembrance of a human tragedy, but rather an affirmation of the necessity of preventing impunity, consolidating the values of justice and human rights, and safeguarding the religious and cultural diversity that characterizes Iraq.
