The College of Law at the University of Mosul discussed, on Sunday, August 9, 2026, the doctoral dissertation titled\u00a0<\/span>“The Legal Regulation of Litigating Against the Estate in Civil Proceedings \u2013 A Comparative Study”<\/span><\/em>, submitted by doctoral student Ahmed Nasser Mustafa Nasser Al-Jahishi, specializing in Private Law \/ Civil Procedure and Evidence Law, under the supervision of Associate Professor Dr. Saddam Khazal Yahya.<\/span><\/p>\n

The dissertation addressed the conceptual framework of litigating against the estate and its legal nature, as well as examining the philosophical and legal foundations for the transfer of the right to sue from the predecessor to the successor, whether the litigation is positive or negative.<\/span><\/p>\n

The study also shed light on one of the most prominent legal problems facing judges, litigants, and their lawyers, namely the manner of directing litigation concerning the estate, in the absence of a clear and consistent criterion to determine the true defendant in such cases, which has led to inconsistencies in judicial decisions.<\/span><\/p>\n

The dissertation aimed to establish the correct legal criteria for determining the cases in which the action is brought against or by the heirs in addition to the estate or in their personal capacity. The study concluded with a proposal for a comprehensive draft law concerning estate liquidation and related disputes.<\/span><\/p>\n

The examination committee consisted of Professor Dr. Tayma Mahmoud Fawzi as Chairperson, with the membership of Professor Dr. Fares Ali Omar, Associate Professor Dr. Aqeel Majid Taha, Associate Professor Dr. Heba Mohammed Mohsen, Associate Professor Dr. Rua Khalil Ibrahim, and Associate Professor Dr. Saddam Khazal Yahya as a member and supervisor.<\/span><\/p>\n
