College of Law Discusses Master’s Thesis on the Theory of Conditions in Civil Law
The College of Law at the University of Mosul held a discussion on Monday, December 23, 2024, for a master’s thesis titled “The Theory of Conditions in Civil Law: A Comparative Study.”
The session was attended by Prof. Dr. Waheed Mahmoud Al-Ibrahimi, President of the University of Mosul, and Assistant Prof. Dr. Wisam Naamat Ibrahim Al-Saadi, Dean of the College of Law, along with several faculty members.
The thesis, presented by researcher Bidaa Saeed Shukri from the Private Law branch , explored the principle of freedom of will, which is fundamental to legal transactions. It highlights how parties are free to bind themselves to obligations and stipulations within transactions to achieve their objectives. However, this principle is not absolute, as legislative provisions impose restrictions and exceptions that parties must adhere to.
The study aims to shed light on the fact that the Iraqi legislator, in addressing the provisions related to conditions under Article 131 of the Iraqi Civil Code, did not include impossible conditions among invalid conditions. This omission could lead to disputes if such a condition is stipulated.

The discussion was chaired by Prof. Dr. Dhnoun Younis Saleh with members Prof. Dr. Mohammed Sadiq Mohammed Abdullah and Lecturer Dr. Nada Mahmoud Dhnoun, alongside Assistant Prof. Dr. Sahar Hayal Ghanem as a member and supervisor.
