Ph.D. dissertation in the Public Law Branch on the penalty of withdrawing work in a general contracting contract / comparative study_ college of law

The Public Law Branch of the College of Law at the University of Mosul discussed a doctoral thesis on the penalty for withdrawing work in a contracting contract on Thursday, April 29, 2021, part of which was attended by Assistant Professor Dr. WissamNemat Ibrahim Al-Saadi, Dean of the Faculty and a number of the faculty teaching

The thesis submitted by the student Fawaz Khalid Abdulaziz in the Public Law Branch dealt with the increasing importance of contracting and public works carried out by the state at the present time because these projects are considered one of the necessary and strategic foundations for strengthening and evaluating its economy abroad, as well as providing the necessary services to citizens at home and as a result of this development in circumstances. Economic and social development in modern societies has had a great impact on the development and expansion of management activity, as the function of management in the first place is to work to achieve the public interest in various areas of life and to reach the best ways to satisfy public needs

The study aims to classify the work withdrawal penalty as one of the pressing and temporary penalties that the administration authority uses with the aim of ensuring the functioning of the public facility so that it does not lead to the termination of the contract, but rather the contractor remains responsible for the implementation of the work. To face his shortcomings, the legal nature of this penalty is due to the prerogative of the public authority, especially its privilege in direct implementation, and in application of the rule of in-kind implementation of commitment to ensure the implementation of the contract on the one hand and to ensure the smooth functioning of public facilities regularly and steadily on the other hand
