Master’s thesis in the branch of private law on considerations outside the harm and their impact on the estimation of compensation / comparative study,,,
On Tuesday, October 11, 2022, the Private Law Branch of the College of Law at the University of Mosul discussed a master’s thesis on considerations outside the harm and its impact on the estimation of compensation. Part of it was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College of Law at the University of Mosul, and a number of members of the College Council and its teachers.
The thesis submitted by the student Shams Sabbar Fathi in the Private Law Branch dealt with what was dealt with in jurisprudence and the judiciary that the basic rule governing the estimation of compensation requires achieving proportionality between it and the harm so that compensation is estimated according to the harm, not less than or greater than it, but rather it should be equal to it. The thesis aims to show that the estimation of compensation for the damage originally estimated in full is sufficient to redress all the damages incurred by the aggrieved party without increase or decrease, whether material damages or moral damages.
The discussion committee was chaired by Prof. Dr. Thanoun Younis Saleh, with the membership of Assistant Professor Dr. Muhammad Siddiq Muhammad, and Assistant Professor Dr. Habib Idris Issa, and the membership and supervision of Prof. Dr. Akram Mahmoud Hussein.
