Master’s thesis in the private law branch on the procedural defect in civil litigation / a comparative study,,,,
On Thursday, October 13, 2022, the Private Law Branch of the College of Law at the University of Mosul discussed a master’s thesis on the procedural defect in civil litigation, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College and a number of members of the College Council and its teachers.
The letter submitted by the student, Maysoon Bashir Khader, in the private law branch dealt with the procedural defect in civil litigation and its role in the pleadings law. Iraqi law and comparing it with other laws, in addition to trying to find effective means to reach adequate practical results that cleanse the procedural defect of the deficiencies that may affect the procedures. Which exposes him to penalty, and every penalty has elements and its legal nature, and every defect that does not affect the procedure. The thesis aims to show that the most important problems of the procedural legislative policy are the balance between the idea of ​​procedural penalty and the protection of substantive rights through the procedure. And whether the mere occurrence of a simple procedural violation makes the procedure flawed and leads to the judgment of the penalty and its nullity, and thus nullifies all other valid procedures that had been taken.
The discussion committee was chaired by Prof. Taima Mahmoud Fawzy, with the membership of Prof. Ahmed Samir Muhammad, the assistant professor, Dr. Saddam Khazal Yahya, and the membership and supervision by the assistant professor, Dr. Faris Ali Omar.
