On Wednesday, October 19, 2022, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on formality in civil litigation/a comparative study, part of which was attended by Assistant Professor Dr.
The letter submitted by the student, Bahjat Abdel Rahman, in the private law branch, dealt with the fact that the origin is represented in the individual exercising his right to resort to the judiciary through a judicial claim, so the litigation is held to issue a ruling on its subject according to the normal course of action. For matters as the principle that governs litigation procedures is legal in form, meaning that the law determines the procedure to be taken.
The thesis reached a statement of the strong link between the idea of ​​justice and formality in judicial procedures, as formality is the means specified by the law to express the judicial procedure in order to appear into existence in a physical appearance arranging its legal effects.
The discussion committee was chaired by Prof. Dr. Yasser Basem Thanoun, with the membership of Prof. Asaad Fadel Mandeel, the teacher, Dr. Ali Obaid Owaid, and the membership and supervision of Prof. Ajyad Thamer Nayef.
