On Sunday, October 23, 2022, the Private Law Branch of the College of Law at the University of Mosul discussed a master’s thesis on procedural fraud in civil advocacy/a comparative study, part of which was attended by Assistant Professor Dr.
The letter submitted by the student Taiba Wathiq Mamdouh in the private law branch dealt with the need for procedural systems to keep pace with all attempts to attack the procedural rule after clearly ascertaining its independent role in protecting the legal system and the principles of justice, because the purpose of the judiciary facility Establishment of justice among people who have the right to resort to the judiciary. The legislator was concerned with regulating the right of litigation and surrounding it with guarantees for the proper course of justice.
The message aims to show that procedural cheating has become an integrated principle that litigants resort to in an attempt to influence the course of procedures and entice the court to the side of those who beg them to obtain rights that have nothing to do with the truth. Moreover, fraud in civil procedures responds to all litigation procedures whose content is separated by the Code of Procedure, starting with Opening the door to civil litigation, leading to a ruling in it.
The discussion committee was chaired by Prof. Dr. Faris Ali Omar, with the membership of Assistant Professor Dr. Saddam Khazal Yahya, Assistant Professor Dr. Saja Omar Shaaban, and the membership and supervision of Prof. Ajyad Thamer Nayef.
