On Sunday, October 30, 2022, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on civil liability for compensation for damages arising from freedom-depriving penalties/a comparative study, part of which was attended by Assistant Professor Dr. .
The letter submitted by the student Mazen Bahjat Fares in the private law branch dealt with the fact that according to the general rules of the Iraqi civil law, the provisions of civil liability in its tortuous part are originally based on personal error and according to legal theories about the sovereignty of the state, the possibility of carrying The state’s responsibility to compensate for the damages arising from penalties that deprive the freedom of individuals without a right is something that cannot be accepted, except that the difference in the damages that the individual is exposed to in his daily life made the issue of the error possible and thus causing material or moral damage, and the possibility of compensating the responsible for the injured.
The message aims to clarify the absence of special legislation in Iraqi law on civil liability for damages arising from penalties depriving freedom, and the principle of separation of powers established by the Iraqi constitution means that each authority is responsible for the actions of its people harmful to others.
The discussion committee was chaired by Prof. Dr. Akram Mahmoud Hussein, with the membership of Prof. Ibrahim Antar Fathi, Assistant Professor Dr. Muhammad Siddiq Muhammad, and the membership and supervision of Assistant Professor Dr. Fathi Ali Fathi.
