Master’s thesis in the private law branch on the principle of freedom of proof in commercial disputes / a comparative study,,,
On Wednesday, March 20, 2024, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on the principle of freedom of proof in commercial disputes, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its faculty.
The thesis submitted by researcher Muthanna Khalaf Khadr in the private law branch dealt with the principle of freedom of proof in commercial disputes, which means that commercial matters should be proven by all means of proof without restriction, even if the value of the legal transaction exceeds the amount specified in civil transactions, except for what is excluded by a special text.
The letter aims to show that the Iraqi legislator and comparative laws did not know the principle of freedom of proof in commercial disputes, which is a good position since defining legal terms is one of the tasks of legal jurisprudence.
The discussion committee was chaired by Professor Dr. Yasser Bassem Thanoun, the membership was Assistant Professor Dr. Muhannad Ibrahim Ali, Assistant Professor Dr. Ali Obaid Awaid, and the membership and supervision of Professor Dr. Taima Mahmoud Fawzi.
