A doctoral thesis in the private law branch on the legal system for legitimate excuse,,,
On Sunday, May 26, 2024, the Private Law Branch at the College of Law at the University of Mosul discussed a doctoral thesis on the legal system of legitimate excuse/a comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its faculty.
The thesis submitted by researcher Muhammad Abbas Jalal in the private law branch dealt with the legal system for the legitimate excuse, which is one of the important systems that plays a major role in changing the legal situation and legal adaptation to suit the circumstances of the person with the excuse, so that he may be misled by mitigating the effects of applying legal texts or reducing the resulting liability. on him .
The thesis aims to show that the legitimate excuse has a basis in Islamic law inspired by the Holy Qur’an and the purified Sunnah of the Prophet, in addition to the regulation of the Iraqi Civil Law, in many legal texts and topics, as it is considered an excuse that prevents the claim of a right or affects legal obligations, which leads to the emergence of the obligation, or its modification, replacement, or End it.
The discussion committee was headed by Professor Dr. Akram Mahmoud Hussein, the membership of Professor Dr. Amer Ashour Abdullah, Assistant Professor Dr. Habib Idris Issa, Assistant Professor Dr. Nizar Hazem Muhammad, Assistant Professor Dr. Sahar Hayal Ghanem, and the membership and supervision of Assistant Professor Dr. Raida Muhammad Mahmoud.
