Master’s thesis in the Private Law Branch on the conclusion of the pleading in a civil suit/Analytical comparative study,,,
The Private Law Branch at the College of Law at the University of Mosul discussed on Sunday, September 1, 2024, a master’s thesis on the conclusion of the pleading in a civil suit/Analytical comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College of Law at the University of Mosul, and a number of members of the College Council and its lecturers.

The thesis submitted by researcher Abeer Farouk Rafiq in the Private Law Branch dealt with the conclusion of the pleading in a civil suit, explaining its concept in light of the Civil Procedure Law No. 83 of 1969, in addition to the definition contained in procedural jurisprudence as a preparatory judicial decision taken by the court when the suit is ready to issue a ruling in it, with reference to the characteristics of this decision that distinguish it from others, as it is suspended on a suspensive condition, as it is a legal duty and right at the same time, and it is also a procedural obstacle to some of the procedures contained in the Civil Procedure Law.
The message aims to show that the nature of the decision to close the pleading is a preparatory judicial decision, despite the proximity of this decision to the jurisdictional decision, which agrees with it in that both of them do not affect the origin of the right claimed and both of them can be revoked, and they cannot be considered as acts of judicial administration. The discussion committee was headed by Professor Dr. Yasser Basem Dhnoon, and the membership of Assistant Professor Dr. Saddam Khazal Yahya, Assistant Professor Dr. Ali Obaid Awad, and the membership and supervision of Assistant Professor Dr. Ziad Muhammad Shahada.
