A doctoral thesis in the Public Law Branch on the legal organization of evidence in administrative lawsuits/a comparative study,,,
On Thursday, September 19, 2024, the Public Law Branch at the College of Law at the University of Mosul discussed a doctoral thesis on the legal organization of evidence in administrative lawsuits/a comparative study, part of which was attended by Professor Dr. Muhammad Siddiq Muhammad Abdullah, Assistant Dean for Scientific and Student Affairs, and a number of members of the College Council and its lecturers.
The thesis submitted by researcher Youssef Fathi Muhammad in the Public Law Branch dealt with evidence in administrative lawsuits, which is of great importance in resolving administrative disputes that can only be done through administrative lawsuits, as they consist of two main unequal parties, the first is the administration as the holder of public authority, which is often in the position of the defendant, and the second is the ordinary individual, who is often in a weaker position than the first party, as it is common and usual to be in the position of the plaintiff seeking administrative justice.
The thesis aims to show that the difference between administrative litigation in the administrative lawsuit and civil litigation in the civil lawsuit due to the special nature of the administrative lawsuit has also been reflected in the difference in the nature of the evidence relied upon in proving both lawsuits, in addition to the lack of equality between the two parties to the lawsuit between the administration as a public authority and the individual plaintiff, which leads to a lack of balance between the parties to the administrative litigation. The discussion committee was chaired by Professor Dr. Qidar Abdul Qader Saleh and the membership of Professor Dr. Fawaz Khalaf Zaher, Assistant Professor Dr. Ahmed Mahmoud Ahmed, Assistant Professor Dr. Ali Muhammad Reda, Assistant Professor Dr. Abu Bakr Ahmed Othman, and the membership of the supervision of Assistant Professor Dr. Naktal Ibrahim Abdul Rahman.
