Scientific workshop

Under the patronage of Professor Dr. Qusay Kamal Al-Din Al-Ahmadi, President of the University of Mosul, and under the supervision and attendance of Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College of Law, and a number of members of the College Council, the Private Law Department in our college, in cooperation with the Continuing Education Unit, held its scientific workshop on Monday, September 30, 2024, entitled “Observations on the Iraqi Arbitration Law Draft for the Year 2024.” The Dean of the College opened the workshop with a speech in which he praised the efforts made by the Presidency of the Private Law Department in holding this workshop, the topic of which is of great importance at the national and international levels. It is worth noting that the commercial arbitration system is one of the means of resolving commercial and investment disputes, and therefore it needs special rules and laws to regulate its provisions. Therefore, finding a legal system for arbitration with the proposal of appropriate legal tools to manage the dispute in arbitration while addressing the problems of the Iraqi Arbitration Law Draft for the year 2024 is one of the main goals of holding this workshop, which witnessed the presentation of a number of our college’s lecturers and researchers with research papers that dealt with a critical reading of the Iraqi Arbitration Law Draft for the year 2024 and referring to the concept of arbitration, its nature and forms, and when it is considered international, with clarification of the principle of the independence of the arbitration agreement, when its provisions can be published, its invalidity and the invalidity claim. The workshop also witnessed the presentation of research papers that provided observations on the implementation of the arbitration decision contained in the above-mentioned draft arbitration law, during which comparisons were presented between the legal rules contained in the Iraqi Civil Procedure Law related to arbitration and the rules contained in the draft arbitration law, the subject of the workshop. The workshop also addressed the arbitration agreement and its definition in jurisprudence and law, its forms and a proposal on its texts and articles, with reference to the termination of arbitration. The workshop also witnessed the presentation of observations on the jurisdiction of the arbitration panel and the party before which the arbitration decision is appealed and the legal period specified for the appeal, with a statement of the dates for the defenses submitted by the other party. The workshop also addressed arbitration procedures, the conditions for selecting the arbitrator and its concept, the definition of the arbitration panel, its formation and tasks, and the conditions that must be met by the arbitrator, as well as the arbitration panel and its formation and the cases of termination of arbitration contained in the law. This workshop comes within a series of scientific, research, cultural and student activities for our college during the current academic year 2024-2025.
