Master’s thesis in the Private Law Branch on the legal organization of voluntary agency/comparative study,,,
The Private Law Branch at the College of Law at the University of Mosul discussed on Monday, October 14, 2024, a master’s thesis on the legal organization of voluntary agency/comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its lecturers.
The thesis, which was presented by researcher Mahmoud Fadhel Obaid, dealt with voluntary agency, which is defined as a person performing a beneficial act by managing the affairs of others without being obligated to do so and without knowledge or opposition, and is an independent source of obligation and is based on pillars, namely the material pillar, which is represented by the legal act, the moral pillar, which is represented by the intention of the voluntary agent to work for the benefit of the employer, and the legal pillar, which is the absence of an obligation or agency between the voluntary agent and the employer.
The message aims to show that the Iraqi legislator in the civil law did not organize the voluntary act and did not address it accurately as comparative legislation did, while it dealt with the incomplete voluntary act related to the actions of the busybody that are suspended on the owner’s permission. The Iraqi legislator did not clarify in the civil law the pillars of the voluntary act, nor its conditions, legal basis, and the provisions on which it is based. The discussion committee was chaired by Professor Dr. Duha Muhammad Saeed, and the membership of Assistant Professor Dr. Muhammad Tahir Qasim, Assistant Professor Dr. Fathi Ali Fathi, and the membership and supervision of Assistant Professor Dr. Habib Idris Issa.
