The College of Law Discusses a Master’s Thesis on Procedural Silence in Civil Litigation
On Monday, November 3, 2025, the College of Law at the University of Mosul discussed a master’s thesis submitted by student Yasser Mahmoud Abdullah Hussein Al-Nuaimi, entitled “Procedural Silence in Civil Litigation: A Comparative Study.”
The examining committee consisted of:

• Assistant Professor Dr. Heba Mohammed Hassan – Member
• Assistant Professor Dr. Ziad Mohammed Shahada – Member
• Assistant Professor Dr. Ali Obaid Owaid – Member and Supervisor
The thesis addressed the concept of “procedural silence” as a procedural aspect that may have legal implications within the context of civil litigation. It explored the extent to which silence can be considered a legally significant stance, despite the general principle that “a statement cannot be attributed to a person who remains silent.” The study also highlighted the penalties imposed by law on those who fail to take the required action within the specified timeframe, given its impact on achieving justice and expediting dispute resolution.
The study aimed to clarify the nature of procedural silence, its provisions, and its practical applications in civil litigation, and to establish a general rule governing this concept in a way that balances the rights of litigants with the requirements of procedural justice.
