On Monday, October 16, 2023, the Public Law Branch at the College of Law at the University of Mosul discussed a doctoral thesis on the administrative judiciary’s oversight of the external legality of the disciplinary decision/a comparative study, part of which was attended by Professor Dr. Alia Abbas Al-Attar, President of the Northern Technical University, and Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi. Dean of the College of Law at the University of Mosul and a number of college council members and faculty.
The thesis submitted by student Muhammad Mudar Yahya in the public law branch dealt with the disciplinary decision issued by the administration, with the importance of it fulfilling its elements, while defining the external legitimacy of the disciplinary decision with its two pillars: jurisdiction, form, and procedures, with an explanation of the feasibility behind canceling the disciplinary decision that is tainted by a defect in its external legitimacy, and the possibility of the judge issuing orders. To the administration for the purpose of making up for the shortcomings that befell the decisions that he canceled.
The study aims to demonstrate the importance of the specialization pillar in the disciplinary field, as disciplinary systems in the world vary depending on the authority responsible for discipline, so it reveals its identity. The form and procedures pillar is also of great importance. It goes beyond being rituals and legal templates in which the administration’s will is expressed. Rather, it embodies the presence of guarantees and careful, thorough study. Or follow transparent procedures that anticipate decision-making.
The discussion committee was headed by Professor Dr. Sami Hassan Najm, the membership of Assistant Professor Dr. Alia Ghazi Musa, Professor Dr. Qidar Abdel Qader Saleh, Assistant Professor Dr. Nectal Ibrahim Abdel Rahman, Assistant Professor Dr. Ahmed Mahmoud Ahmed, and the membership and supervision of Assistant Professor Dr. Ali Muhammad Reda.
