Master’s thesis in the Private Law Branch on the Theory of Condition in Civil Law / Comparative Study,,,
On Monday, December 23, 2024, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on the Theory of Condition in Civil Law, part of which was attended by Professor Dr. Wahid Mahmoud Al-Ibrahimi, President of the University of Mosul, Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College of Law, and a number of members of the College Council and its lecturers.
The thesis submitted by researcher Baidaa Saeed Shukri in the Private Law Branch dealt with the principle of freedom of will, which is the basis of legal actions, as the parties are considered free in what they oblige themselves to and stipulate in terms of subsidiary obligations with conditions included in the action to reach their goal from it, but this principle is not absolute as the legislation has included restrictions and exceptions that the parties may not exceed.
The message aims to show that the Iraqi legislator, when dealing with the provisions related to the condition in Article 131 of the Iraqi Civil Code, did not include the impossible condition among the invalid conditions, and this neglect of this type of condition may raise controversy when it is stipulated. The discussion committee was chaired by Professor Dr. Dhnoon Younis Saleh, with the membership of Professor Dr. Muhammad Siddiq Muhammad Abdullah, the lecturer Dr. Nada Mahmoud Dhnoon, and the membership and supervision of Assistant Professor Dr. Sahar Hayal Ghanem.
