On Monday, December 5, 2022, the Human Rights Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on the role of the European Court of Human Rights in interpreting human rights conventions. Part of it was attended by Professor Dr. Khalaf Ramadan Muhammad, Associate Dean for Administrative and Financial Affairs, and a number of members of the College Council. And her teachers.
The thesis submitted by the student Amjad Sharif Ali in the Human Rights Law branch dealt with the importance of interpreting international conventions on human rights, which are prominent due to the distinctive features of these conventions from others, as the process of interpreting international conventions is a prerequisite for their application, since interpretation is what transfers the conventions from the world of stillness To the world of movement, just as the subject and purpose of the agreements require unity in the obligations arising from the state parties.
The thesis aims to show that the judicial interpretation of international treaties is inherent to the judicial function exercised by the judge, whether it is assumed by an international judge or an internal judge. Therefore, the interpretation is at the heart of the judicial function, and in principle the judge must do it on his own, unless his authority is restricted in the system. the legal framework within which this function is exercised.
The discussion committee was chaired by Assistant Professor Dr. Ziyad Abdel-Wahhab Abdullah, with membership of Assistant Professor Dr. Shaimaa Abdel Sattar Jabr, teacher Dr. Haider Yahya Thamer, and membership and supervision of Assistant Professor Dr. Fathi Muhammad Fathi.
