Master’s thesis in the Private Law Branch on the role of custom in commercial transactions / comparative study,,,
On Wednesday, January 15, 2025, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on the role of custom in commercial transactions / comparative study, part of which was attended by Professor Dr. Munir Salem Taha, Assistant President of the University of Mosul for Scientific Affairs, Professor Dr. Khalaf Ramadan Muhammad, Assistant Dean for Administrative and Financial Affairs, and a number of members of the College Council and its lecturers.
The thesis submitted by researcher Rand Ihsan Habib in the Private Law Branch dealt with custom, which is the basis on which national commercial laws and international commercial rules are built, as it is one of the oldest sources of commercial law in existence, as it stems from individuals in the commercial community to meet their needs and facilitate their commercial transactions.
The message aims to show that custom consists of two pillars without which it cannot be formed together, which are material and moral. Also, the customary rule is an unwritten legal rule that shares the same characteristics with the written legal rule. In addition, the status of custom varies in legislation according to the law. In some of them, it has the utmost importance, and in others, it has no role at all. The discussion committee was chaired by Professor Dr. Mustafa Natiq Saleh, with the membership of Assistant Professor Dr. Radwan Hashim Hamdoun and the expert Dr. Muhammad Yunus Salman, and the membership and supervision of Assistant Professor Dr. Munhal Abdul-Ghani Mustafa.
