A Legal Perspective on Evening Studies in Iraqi Universities and Institutes

A specialized legal article by Assistant Professor Dr. Saddam Khazal Yahya, a lecturer in the Private Law Department at the College of Law at the University of Mosul.

The mechanism for evening studies in Iraqi universities and institutes is governed by Instructions for the Establishment of Evening Studies in Iraqi Universities, Colleges, and Institutes No. 135 of 2000. These instructions outline the requirements for establishing evening studies, as well as the powers of the Higher Authority supervising evening studies at the university and the supervisory bodies at the colleges, in accordance with Article 4 thereof. This includes approving the academic and administrative staff and determining the remuneration of their employees. The supervisory body at the colleges has the authority of the College Council with regard to these studies, and the Higher Authority has the authority equivalent to the University Council with regard to its work. The above instructions examine the mechanism for handling students’ abandonment and withdrawal from evening studies. The first amendment to these instructions, effective December 23, 2024, was recently issued. It clarifies the consequences of a student leaving studies before ten days have passed since starting, the fees they will be entitled to if they leave after that time, and the additional fees they will be entitled to if they leave after that time. Provisions related to this field, and ministerial regulations play a complementary role in this direction, supporting the work and implementation of these studies.
