PhD thesis in the private law branch on alternative means of conflict resolution in personal status / comparative study
On Wednesday, October 8, 2021, the Private Law Branch of the College of Law at the University of Mosul discussed a doctoral thesis on alternative means of settling disputes in personal status/a comparative study, part of which was attended by Assistant Professor Dr. The college was honored by the presence of Prof. Dr. Alia Al-Attar, President of the Northern Technical University
The thesis presented by the student Abdul Majeed Muhammad Hamoudi in the private law branch dealt with the family, which is the basis in the formation of society and the basic building block for it. Among its members, it threatens its stability and organization, which calls for its protection
The study aims to show that the term alternative means of conflict resolution is a contemporary term that was not used by the ancient Muslim jurists in their books, and that the legality of working with alternative means of conflict resolution is established in Islamic jurisprudence and comparative legislation, where these means aim to settle personal status disputes amicable settlement between the parties to the conflict with the aim of achieving better The results that lead to the achievement of mutual benefits between the opponents and are characterized by flexibility and confidentiality, and not all personal status issues are suitable for settlement by alternative means
The discussion committee was chaired by Prof. Dr. Nickel Mahmoud Salloum, with the membership of Dr. Qahtan Hadi Abdullah, Dr. Nadia Khair El-Din Aziz, Dr. Obaid Abdullah Zidan, Dr. Habib Idris Issa, and the membership and supervision of Dr. Yasser Basem Thanoun
