On Thursday, August 24, 2023, the Private Law Branch at the Faculty of Law at the University of Mosul discussed a doctoral thesis on restricting the right of shareholders to manage a joint stock company / a comparative study, part of which was attended by Prof. Dr. Qusai Kamal Al-Din Al-Ahmadi, President of the University of Mosul, Father Raed Adel, Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of our college, and a number of members of the councils of the University of Mosul and the Faculty of Law and its teachers. The thesis submitted by the student Diaa Hadaf Zia in the branch of private law dealt with the joint stock company, which is within the range of money companies that the law generally regulates the relationship between them and the shareholders of others and transactions with them as the law regulates part of the rights of shareholders in these companies and the most important of these rights is the right of the shareholder to manage the joint stock company and the restrictions that respond to this right and what are the effects that respond to the restriction of this right.
The study aims to show that the legal basis for the right of shareholders to manage the joint stock company according to the theory of the company’s acquisition of the legal personality is only complementary to the legal basis of the right of shareholders to manage the joint stock company in accordance with the principle of the authority of the will as the legal nature of the right of shareholders to manage the joint stock company does not depart from the concept of the right of a special kind can be called the right of guidance or the right of management, which is the result of the special nature of the legal person who is unable to express his will only Through a representative of him.

The discussion committee was headed by Prof. Dr. Mustafa Natiq Saleh and the membership of Prof. Dr. Zakaria Younis Ahmed, Assistant Professor Dr. Bushra Khaled Turki, Assistant Professor Dr. Aysar Essam Daoud, Assistant Professor Dr. Rayan Hashem Hamdoun, and the membership and supervision of Assistant Professor Dr. Muhannad Ibrahim Ali.
