On Wednesday, November 22, 2023, the Public Law Branch at the College of Law at the University of Mosul discussed a doctoral thesis on the legal regulation of the enforcement of an administrative decision associated with the condition of financial approval/a comparative study, part of which was attended by Professor Dr. Munir Salem Taha, Assistant President of the University of Mosul for Scientific Affairs, and Assistant Professor Dr. Wissam. Nemat Ibrahim Al-Saadi, Dean of the College, and a number of College Council members and faculty.
The thesis submitted by researcher Zahraa Hisham Ibrahim in the branch of public law dealt with the legal existence of the administrative decision, which is achieved from the date of its signing and is considered effective against the administration from this time and from the date of its publication or notification to individuals, where the importance of determining the effective time of the administrative decision is highlighted in the possibility of protesting against it. Confronting individuals and their right to adhere to the decision in the face of administration.
The thesis aims to explain that the effectiveness of the administrative decision means its validity, which begins from the issuance of the decision and ends with its expiration. The administrative decision generates an intrinsic executive force that finds its argument in the presumption of legality, whether present or non-existent.
The discussion committee was headed by Professor Dr. Ahmed Khorshid Hamidi, the membership of Professor Dr. Qidar Abdul Qadir Saleh, Assistant Professor Dr. Fawaz Khalaf Zahir, Assistant Professor Dr. Ali Muhammad Reda, Assistant Professor Dr. Abu Bakr Ahmed Othman, and the membership and supervision of Assistant Professor Dr. Ahmed Mahmoud Ahmed.
