On Monday, March 18, 2024, the Private Law Branch at the College of Law at the University of Mosul discussed a master’s thesis on the legal system for managing civil lawsuits / a comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its faculty.
The thesis submitted by researcher Asaad Hamid Ibrahim in the private law branch dealt with the case management system, which is based on activating alternative methods to litigation and trying to resolve disputes amicably, whether by settlement, compromise, or otherwise, in addition to completing the case file and seeking to limit the evidence by meeting with The parties to the case before referring its file to the trial judge to decide on its merits.
The letter aims to state that the Iraqi legislator did not adopt the civil case management system in the Iraqi Civil Procedure Law No. 83 of 1969, nor in any other special law, nor did the comparative laws that adopted the case management system provide a definition of this system, but rather stipulated its organization within legal texts.
The discussion committee was chaired by Professor Dr. Fares Ali Omar, with the membership and supervision of Professor Dr. Ajyad Thamer Nayef, Assistant Professor Dr. Saddam Khazal Yahya, and the membership and supervision of Professor Dr. Taima Mahmoud Fawzi.
