On Sunday, 28 June 2026, the College of Law at the University of Mosul witnessed the defense of a doctoral dissertation presented by researcher Mahmoud Muhammad Sharif Muhammad Salih Al-Rawi, entitled “The Philosophy of Balance between Human Rights and the Rules of Compulsory Execution – A Comparative Study”, under the supervision of Professor Dr. Yasser Basim Dhanoun Al-Sab’awi.

The dissertation sought to elucidate the philosophy of the procedural legislator in achieving a balance between the creditor’s right to recover his dues and the debtor’s right to preserve his dignity, humanity, and fundamental rights, in light of international charters and national constitutions. The study also addressed the concept of the humanization of compulsory execution procedures, by striking a fair balance between the interests of the creditor and the debtor, ensuring the effectiveness of execution while respecting the principles of human rights.

The study emphasized the importance of developing the rules of compulsory execution in a manner that achieves efficiency in the recovery of rights, without infringing upon the debtor’s dignity or fundamental rights. It proposed legal treatments and provisions that would contribute to eliminating discrepancies in judicial applications and enhance the achievement of justice and balance between the parties to the execution relationship.

At the conclusion of the defense, the committee praised the scientific effort exerted by the researcher and the importance of the topic in addressing one of the most prominent contemporary legal issues, given its impact on enhancing the balance between the requirements of compulsory execution and the guarantees of human rights.
