The Public Law Branch at the College of Law at the University of Mosul discussed a higher diploma research on purchasing at the expense of the supplier in the administrative supply contract / a comparative study on Tuesday, June 22, 2021

Part of it was attended by Assistant Professor Dr. WissamNemat Ibrahim Al-Saadi, Dean of the College, members of the College Council and a number of its lecturers

The research presented by the student Ali Hassan Muhammad Ali in the Public Law Branch dealt with penalties in administrative contracts, of which the supply contract is one of them. These contracts aim to ensure the regular and steady functioning of the public facility, so the administration resorts to achieve this by a kind of penalties intended to pressure the contractor to implement its contractual obligations

The study aims to show that one of the characteristics of purchasing at the expense of the supplier is a temporary penalty, as the administration does not terminate the contract with the contractor who breaches his obligations with it, but rather keeps the contract in place between them, and if the contractor is unable to deny the grave error on his part and prove the return of that mistake to a foreign cause he In it, the administration can resort to imposing a penalty on him and executing the contract at his expense and under his responsibility for committing a serious error in his contractual responsibility

The discussion committee was chaired by the assistant professor, Dr. Ahmed Mahmoud Ahmed, and the membership of Dr. Abu Bakr Ahmed Othman, and the membership and supervision of Dr. Nektel Ibrahim Abdul Rahman
