Doctoral dissertation in the private law branch on the legal system for modern matters in common money/comparative study,,,
On Monday, May 13, 2024, the Private Law Branch at the College of Law at the University of Mosul discussed a doctoral thesis on the legal system for modern matters in common money / a comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its teachers.
The thesis presented by researcher Muhammad Shaker Mahmoud in the private law branch dealt with the scope of the new properties established by the partner in common property, which are limited to one of the forms of construction, facilities, and plantings. In order for them to apply to the description of new properties, they must be firmly connected to the property such that they merge with it in a way that it is impossible to separate or remove them without being attached. With common money there is no harm.
The thesis aims to show that the Iraqi legislator, through the text of Article 1061 of the Civil Code, has overlooked an essential characteristic of common property, which is that the shares are not divided, and this mixing of shares is what distinguishes common property from other forms of ownership.
The discussion committee was chaired by Professor Dr. Duha Muhammad Saeed, with the membership and supervision of Professor Dr. Muhammad Siddiq Muhammad Abdullah, Assistant Professor Dr. Ali Salah Yassin, Assistant Professor Dr. Fathi Ali Fathi, Assistant Professor Dr. Sahar Hayal Ghanem, and the membership and supervision of Professor Dr. Yusra Walid Ibrahim.
