On Monday, July 18, 2022, the Private Law Branch of the College of Law at the University of Mosul discussed a master’s thesis on the relativity of the effect of the contract / a comparative study, part of which was attended by the assistant professor Dr. Wissam Nemat Ibrahim Al-Saadi, the dean of the college and a number of members of the college council and its teachers.

The letter submitted by the student Falah Qanbar Ali in the Private Law Branch dealt with what the Iraqi legislator stated regarding the definition of obligation in Article 69 of the Iraqi Civil Code, where it could have achieved its purpose if the words were shortened, and it was possible to avoid confusion between obligation and personal right and count them with the word religion synonyms For some .

The study aims to show that the phrase “the effect of the contract goes to the contracting parties and the general successor” contained in the text of Article 142 suggests from the apparent meaning of the text that the contracting parties and the general successor are present at the same moment and that the effect of the contract goes to them together, while the legislator’s intention is to leave the effect of the contract to the contracting party and in the event of his death to his back.

The discussion committee was chaired by Prof. Dr. Thanoun Younis Saleh, with the membership of Assistant Professor Dr. Raeda Muhammad Mahmoud, Assistant Professor Dr. Sahar Hayal Ghanem, and the membership and supervision of Prof. Akram Mahmoud Hussein.
