Master’s thesis in the Private Law Branch on the establishment of the theory of certainty in civil law,,,

The Private Law Branch at the College of Law at the University of Mosul discussed on Sunday, February 23, 2025, a master’s thesis on the establishment of the theory of certainty in civil law / a comparative study, part of which was attended by Assistant Professor Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the College, and a number of members of the College Council and its lecturers.

The thesis submitted by the student Nour Wael Ali in the Private Law Branch dealt with certainty that is not removed by doubt, but by certainty according to the rules of jurisprudence. The Iraqi legislator has adopted the above rule in some of its branches in civil law according to the legal formulation contained in the Journal of Judicial Rulings, excluding the organization of this rule in an independent text despite its importance in most issues related to contemporary financial transactions.

The thesis aims to show that the rule of certainty is not removed by doubt is one of the rules that are suitable to be evidence from which rulings are derived in the law, and that the basis of this rule is the definitive knowledge with which all possibility is negated.

The discussion committee was headed by Professor Dr. Akram Mahmoud Hussein, and included Assistant Professor Dr. Habib Idris Issa, Assistant Professor Dr. Raeda Muhammad Mahmoud, and the membership and supervision of Assistant Professor Dr. Sahar Muhammad Najib.
