PhD thesis in the private law branch on the right of the company to own its shares

On Monday, September 5, 2022, the Private Law Branch of the College of Law at the University of Mosul discussed a doctoral thesis on the company’s right to own its shares, part of which was attended by Prof. Dr. Munir Salem Taha, the assistant president of the University of Mosul for Scientific Affairs, and the assistant professor, Dr. Wissam Nemat Ibrahim Al-Saadi, Dean of the Faculty and a number of members of the Board of Directors The college and its teachers.

The study presented by the student Reem Thanoun Younes in the private law branch dealt with the company’s ownership of its shares, which is one of the important operations that take place in the stock market, with the exception of the Iraq Stock Exchange, as no special legislation was issued in this regard. It was referred to in the Iraqi Banking Law No. 94 of the year 2004 without regulation, and according to the process of the company owning its shares that it had previously issued, it controls part of its capital. It is considered a dangerous process if it is financed with funds deducted from the capital itself. Therefore, the company’s capital in this part becomes fictitious or fictitious.

The study aims to show that the process of the joint stock company owning its shares through the stock market with the intention of reducing the capital or its consumption or with the intention of distributing it to its employees, and the process is carried out by the joint stock company. Iraqi Banking Law No. 94 of 2004.

The discussion committee was chaired by Prof. Dr. Mustafa Nathiq Saleh, with the membership of Prof. Zakaria Younis Ahmed, Assistant Professor Dr. Muhannad Ibrahim Ali, Assistant Professor Dr. Bushra Khaled Turki, Assistant Professor Dr. Raed Ahmed Khalil, and the membership and supervision of Assistant Professor Dr. Essam Daoud.
