On Monday, October 25, the Private Law Branch of the College of Law at the University of Mosul discussed a doctoral thesis on the legal regulation of the unaccounted for in the inheritance of relative homeowners, part of which was attended by the assistant professor Dr.
The thesis submitted by the student Muhammad Yahya Qassem in the private law branch dealt with inheritance, which is considered one of the legal and legal sciences, and its provisions are definitive and indicative, especially with regard to the provisions of the inheritance of the owners of relative assumptions because of them are what is mentioned in the Holy Qur’an Including what was mentioned in the purified Sunnah of the Prophet, including what was stated in the consensus. As for the position of Iraqi legislation and comparative legislation on the inheritance of the owners of relative hypotheses, they differed in their organization, as some legislation adhered literally to the legal texts and the Prophet’s Sunnah and the rules agreed upon by the schools of jurisprudence, while others followed There are many ways to legislate or apply these provisions.
The thesis aims to show that the Iraqi Personal Status Law has remained silent about identifying the owners of the assignments and clarifying their assignments and their shares, and by his silence he referred the issues that were not mentioned in a text to the principles of Islamic Sharia. The most appropriate to the provisions of the law, in addition to what was stated in Article 90 of the law, that one of the Sunni or Jaafari jurisprudence must be applied according to the doctrine of the deceased.
The discussion committee was chaired by Prof. Hamid Sultan Ali, with the membership of Assistant Professor Dr. Qahtan Hadi Abd, Assistant Professor Dr. Nadia Khair El-Din Aziz, Assistant Professor Dr. Nashwan Zaki Suleiman, Assistant Professor Dr. Saud Azhar Abdullah, and the membership and supervision of Prof. Dr. Yasser Basem Thanoun.
