PhD Thesis Discussion at the College of Law on the Legal System of Family Companies

The College of Law witnessed the discussion of a PhD thesis by student Hussein Naif Yahya Al-Obaidi on Thursday, April 9, 2026, under the supervision of Professor Dr. Mustafa Natiq Salih, and attended by a specialized scientific committee.

The thesis, titled “The Legal System of Family Commercial Companies – An Analytical Study,” sheds light on the legal framework regulating this type of company through an in-depth analytical study divided into three chapters, preceded by an introduction and concluded with a summary containing the most prominent findings and recommendations.

The thesis addressed the conceptual and legal framework of family companies in terms of definition, characteristics, types, and legal nature. The second chapter focused on the establishment of these companies and their management mechanisms, particularly the role of the family council, in addition to the challenges facing their governance. The third chapter was dedicated to examining disputes arising within family companies and methods of resolving them, while clarifying the position of legislations on dispute resolution mechanisms.

The study aimed to analyze the legal system of family companies to ensure their continuity across generations, and to establish clear governance mechanisms that separate ownership from management, thereby contributing to organizing the relationship between family members and the company, defining responsibilities, and addressing disputes. The thesis also emphasized the importance of legislative reform by proposing a draft law specifically for family companies to fill the legislative gap in Iraqi law.

A book authored by Professor Dr. Yasser Basim Al-Sabawi, titled "Liability of Third Parties in Compulsory Execution / A Comparative Study," has been published by the Legal Research Center in Erbil.
