The College of Law at the University of Mosul witnessed today, Wednesday, August 26, 2026, the discussion of the master’s thesis titled “Administrative Liability for the Execution of Public Works Contracts: A Comparative Study” , presented by the researcher Wafaa Hazem Awad Al-Ma’mari, under the supervision of Assistant Professor Dr. Hassan Talal Younis.

The thesis addressed the topic of administrative liability arising from the execution of public works contracts, and its role in achieving financial balance between the administration and the contractor, as well as ensuring the regular operation of public utilities. This was accomplished by examining the concept of liability and its legal basis, the circumstances under which it arises and its effects—whether based on fault or no-fault liability based on risk—along with mechanisms for compensation and the restoration of the financial balance of the contract, in addition to the legal and judicial guarantees established for the contractor.

The study aimed to clarify the conceptual and legal framework of administrative liability resulting from the execution of public works contracts, to explain the circumstances under which it arises and its effects on the legal and financial positions of both parties to the contract, and to outline the judicial and procedural guarantees established for claiming compensation and restoring the financial balance of the contract. It also sought to assess the adequacy of legislative provisions and comparative judicial applications, identify shortcomings and practical issues that may arise during the execution phase, and propose legislative solutions capable of protecting the contractor’s rights against administrative arbitrariness, while ensuring the protection of public funds and the continued operation of public utilities.
